Welcome to Kampe! By creating a Kampe Account or using any Kampe Services, you agree to be bound by the following terms and conditions (the "Terms of Service").

As used in these Terms of Service, "we", "us", "our" and "Kampe" means Xapisoft Co. Limited, and "you" means the merchant registering for or using the Kampe Service, whether as an individual or on behalf of a business.

Kampe provides a commerce platform that enables merchants to build and customize online stores, sell products and services, manage orders, and accept payments. Any new features or tools added to the current Services will also be subject to these Terms of Service. You can review the current version at any time at kampestore.com/legal/terms.

You must read, agree with, and accept all of the terms and conditions in these Terms of Service, including our Acceptable Use Policy and Privacy Policy, before you may create a Kampe Account or use any Kampe Service.

1. Account Terms

You are responsible for your Account, the content you publish on your Kampe Store, and the operation of your store. If you violate these terms, we may suspend or cancel your access.

To access and use the Services, you must register for a Kampe account ("Account"). To complete registration, you must provide your full legal name, a valid phone number, a valid email address, and any other information indicated as required. Kampe may reject your application, or cancel an existing Account, for any reason at our sole discretion.

You must be at least 18 years of age to open an Account.

You confirm that you are using the Services for business purposes and not for any personal, household, or family purpose.

You are responsible for keeping your login credentials secure. Kampe cannot and will not be liable for any loss or damage resulting from your failure to maintain the security of your Account.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without the express written permission of Kampe.

2. Account Activation

The person who signs up is the Store Owner and is responsible for the Account. Your store is linked to one Store Owner. You are responsible for activating your payout account and keeping it in good standing.

2.1 Store Owner

The person signing up for the Service by opening an Account will be the contracting party ("Store Owner") and will be the person authorized to use any corresponding Account. If you are signing up on behalf of your employer, your employer will be the Store Owner.

Your Kampe Store can only be associated with one Store Owner. A Store Owner may operate multiple Kampe Stores under separate Accounts.

2.2 Payout Account

To receive payouts from online sales, you must connect a valid payout account to your Kampe Account. You are solely responsible for activating, maintaining, and ensuring the accuracy of your payout details. Kampe will not be liable for failed or delayed payouts resulting from incorrect or inactive payout credentials.

Payouts are subject to a minimum threshold and a payout processing fee, as listed on our pricing page.

3. Kampe Rights

Kampe controls who can access the Services and can modify them at any time. We can remove content that violates our policies. We may serve other merchants in your industry but will never share your confidential information with them.

Not all Services or features will be available to all merchants at all times, and we are under no obligation to make any feature available in any particular form. We reserve the right to modify the Services or any part thereof for any reason, without notice and at any time.

It is at Kampe's sole discretion to refuse or remove any content from any part of the Services, including if we determine that the goods or services you offer, or the content you post, violates our Acceptable Use Policy or these Terms of Service.

Verbal or written abuse of any kind directed at any Kampe employee or officer will result in immediate Account termination.

4. Your Responsibilities

You are responsible for your Kampe Store, the products or services you sell, and your relationship with your customers. Kampe is not a marketplace. Any contract of sale is directly between you and your customer.

You acknowledge and agree to maintain public-facing contact information, terms of service, a refund policy, and order fulfilment timelines on your Kampe Store.

Kampe is not a marketplace. Any contract of sale made through the Services is directly and solely between you and your customer. You are the seller of record for all sales through the Services. You are responsible for:

  • Creating and operating your Kampe Store and all content published on it
  • The products and services you sell and their descriptions, pricing, and accuracy
  • Authorizing and processing customer payments
  • Determining and collecting applicable taxes
  • Handling refunds, returns, and customer service
  • Compliance with all applicable laws and regulations
  • Any fraudulent transactions initiated from your Store

You represent and warrant that you will comply with all applicable laws, rules, and regulations in your use of the Services.

5. Payment of Fees

You must maintain a valid payment method to pay your subscription fees. Your store will be frozen (not deleted) if payment fails. A transaction fee applies to all online payments processed through Kampe.

You will pay the fees applicable to your subscription ("Subscription Fees") and any other applicable fees, including transaction fees relating to online payments processed through Kampe ("Transaction Fees") and fees relating to payouts ("Payout Fees"). Together, these are referred to as the "Fees". Current Fees are listed on our pricing page.

Subscription Fees are billed monthly in advance. If we are unable to process payment on your billing date, we will make subsequent attempts. If payment remains unsuccessful after 7 days, your Store will be frozen. A frozen Store is not deleted; your data, products, and settings are preserved. Your Store will be reactivated upon payment of any outstanding Fees.

Unless otherwise indicated, all Fees are stated in the currency displayed at the time of purchase. You are responsible for any applicable taxes arising from your use of the Services.

Kampe does not provide refunds on Subscription Fees for partial billing periods.

6. Confidentiality

Both you and Kampe agree to keep each other's confidential business information private and to use it only for the purposes of these Terms of Service.

"Confidential Information" includes any and all information associated with a party's business and not publicly known, including business processes, customer data, pricing, financial information, and product details. Kampe's Confidential Information includes all information you receive relating to Kampe or the Services that is not known to the general public.

Each party agrees to use the other party's Confidential Information solely as necessary for performing obligations under these Terms of Service, and to take reasonable steps to prevent unauthorised disclosure or use of such Confidential Information.

7. Limitation of Liability and Indemnification

We are not responsible for damages or losses that arise if you break the law, breach this agreement, or violate the rights of a third party. The Services are provided on an "as is" basis. Our liability is limited.

To the extent permitted by applicable law, Kampe and its affiliates will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other losses arising out of or relating to the use of or inability to use the Services.

You agree to indemnify and hold Kampe, Xapisoft Co. Limited, and their officers, directors, employees, and agents harmless from any claim or demand arising out of:

  • Your breach of these Terms of Service
  • Your violation of any law or the rights of a third party
  • Any aspect of the transaction between you and your customers, including refunds, fraudulent transactions, or alleged violation of applicable consumer protection laws

Your use of the Services is at your sole risk. The Services are provided on an "as is" and "as available" basis without any warranty, express or implied. Kampe does not warrant that the Services will be uninterrupted, timely, secure, or error-free.

8. Intellectual Property and Your Content

Any content you upload remains yours. By uploading it, you give Kampe a licence to host and display it as part of operating the Services. Kampe's name, logo, and platform remain Kampe's property.

8.1 Your Content

We do not take ownership of the content you provide to Kampe. However, by uploading content to your Store, you grant Kampe a non-exclusive, royalty-free, worldwide licence to host, store, display, and reproduce your content solely for the purpose of operating and providing the Services.

You represent and warrant that you have all necessary rights to the content you upload and that it does not infringe the intellectual property rights of any third party.

8.2 Kampe Intellectual Property

You agree that you may not use Kampe's name, logo, trademarks, or service marks without prior written authorisation from Kampe. You agree not to register or use any domain names, social media handles, or brand identifiers that may be confused with the Kampe brand.

9. Acceptable Use

Kampe may be used only for lawful commerce. There are certain products and activities that are prohibited on the platform. Violations may result in immediate Store suspension or termination.

Your use of the Services must comply with our Acceptable Use Policy, available at kampestore.com/legal/aup. You may not use Kampe to sell or promote:

  • Counterfeit, stolen, or illegally obtained goods
  • Narcotics, controlled substances, or drug paraphernalia
  • Weapons, firearms, or ammunition
  • Adult content or services
  • Products or services that violate any applicable law or regulation
  • Any goods or services that promote violence, hatred, or discrimination

Kampe reserves the right to remove any product listing or Store content that violates this policy and to suspend or terminate Accounts accordingly.

10. Privacy and Data Protection

Kampe is committed to protecting your personal information and the personal information of your customers. Our full Privacy Policy is available at kampestore.com/legal/privacy.

Kampe's collection, use, and processing of your personal information and that of your customers is governed by our Privacy Policy, available at kampestore.com/legal/privacy.

By using the Services, you acknowledge that you are responsible for obtaining any necessary consents from your customers for the collection and processing of their personal data in connection with their purchases from your Store.

11. Term and Termination

You may cancel your Account at any time by contacting Kampe support. We may suspend or terminate your Account for violations of these Terms. A frozen store due to non-payment is not the same as termination. Your data is preserved.

These Terms of Service begin on the date you complete registration and continue until terminated by either party.

You may cancel your Account and terminate the Terms of Service at any time by contacting Kampe support at support@kampestore.com. Upon cancellation, your Store will be taken offline and you will retain access to export your data for 30 days.

Without limiting any other remedies, we may suspend or terminate your Account at any time if we suspect you have engaged in fraudulent activity, violated these Terms of Service, or violated our Acceptable Use Policy.

Upon termination:

  • Kampe will cease providing you with the Services and you will no longer be able to access your Account
  • Any outstanding balance owed to Kampe will immediately become due and payable
  • Any pending payouts that meet the minimum threshold will be processed within 14 business days
  • Your Kampe Store will be taken offline

12. Modifications

We may update these Terms from time to time. We will notify you of material changes. Your continued use of the Services after changes are posted means you accept the updated Terms.

We reserve the right to update or change any portion of these Terms of Service at any time. We will provide you with reasonable advance notice of material changes by sending an email to your registered email address or by posting a notice through the Kampe merchant dashboard.

We may make changes with immediate effect for legal, regulatory, fraud prevention, or security reasons. Your continued use of the Services after notice of changes constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Services.

Kampe may change its Fees from time to time and will provide 30 days advance notice of any fee changes.

13. General Conditions

These Terms of Service constitute the entire agreement between you and Kampe and govern your use of the Services, superseding any prior agreements between you and Kampe.

These Terms of Service will be governed by and interpreted in accordance with the laws of the jurisdiction in which Xapisoft Co. Limited is registered. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Kampe's failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
